1. INTRODUCTION

APOLOTOURS doo Golootočkih žrtava street bb, Old Bakery Complex, Dubovica, 85310 Budva (hereinafter as Agency), is receptive tourist agency with licence of Tour operator No 215 issued by the Ministry of Tourism of Montenegro. The Agency organises multi day tours and daily excursions in Montenegro and neighbouring countries, provides transfers and accommodation. It guarantees the authenticity of all the tours and excursions offered on the web site www.bookmontengrotour.com. By accepting an offer presented on the web site the client enters a legal relationship with the Agency and confirms that he/she accepts the General Terms and Conditions of the presented here.

2. BOOKING AND PAYMENT CONDITIONS

Booking inquiries for tours and daily excursions are sent electronically by filling the online form on our web site. Within 24 hours the Traveler receives further payment information for the service within the defined deadline.

By making a payment, the Traveller confirms that he/she is aware of the Terms and Conditions and fully comprehends and accepts these terms which are binding both for the Traveller and the Agency.

Booking of the tours requires deposit payment of 30% following one of the payment models stated in this document and based on the invoice sent by the Agency. Upon receiving the deposit the Agency issues payment confirmation and voucher which contains all details of the tour or excursion (Clients details, dates and itinerary). The balance is to be paid the latest 14 days prior to the tour start, upon which the Clients receives a voucher with all details of the service (Clients details, dates and itinerary).

Booking of daily excursions is confirmed upon total payment as stated on the web site and invoice. After receiving the payment Agency issues payment confirmation and voucher with all details of the service (Clients details, dates and itinerary).

Payments are possible by Credit Card Off-line with VISA, MASTER CARDS & MAESTRO

By fulfilling the Credit Card Authorization Form (containing the clients details, address, credit card details, exact amount and purpose), the Clients authorise the Agency to charge the amount according to the invoice.

The credit card will be charged in EUR rate according to the selling foreign exchange rate of CBCG (Central bank of Montenegro) on the charge date. Differences and fluctuations between the exchange courses of CBCG and the Traveller’s credit card company are possible. All banking expenses, as well as any other additional expenses concerning the payment procedure, are taken by the Traveller.

For all the credit card offline payments the Agency charges additional 4% of the paid amount.

3. AGENCY’S OBLIGATION

Apolotours agency is responsible for the execution of the services as described and advertised on the web site www.bookmontengrotour.com taking into consideration the rights and interests of the Traveller in accordance with the good practice in tourism. Therefore it is liable to the Traveller for non-fulfilment of the services the guest paid for.

The Agency excludes every liability for non fulfilment of the services due to force majeure situation either in Traveller’s country or in the country where the service is provided (such as war, strike, terrorist attacks, natural disasters, earthquake, floods, official authority interventions, borders closing, etc), in which case the paid deposit will be refunded deducted by the transaction costs.

4. MINIMUM PATICIPANTS

The guided tours and daily excursions advertised on the web site can be organised with a minimum 4 participants. The Agency charges the booking amounts ONLY after the minimum participants is met and confirmed in written. The Agency reserved the right to cancel the tour/excursion until 15 days prior to starting the tour in case the minimum group size is not met. In that case the Travellers is offered to choose between an alternative tour or a surcharge for the less then minimum participants. This cancellation is free of charge.

5. TRAVELLER’S OBLIGATION

The Traveller is obliged to have own valid travel document. The cost for loss of the travel documents are borne by the Traveller. The Traveller is obligated to check prior to travel whether he/she needs visa to enter Montenegro or neighbouring countries mentioned in the tour itinerary. Apolotours cannot provide the service of obtaining a visa for the Traveller and reserves the right to keep the paid amount for the tour in case the Travellers hasn’t provided the valid travel documents.
In order to book the tour the Traveller is obliged to submit the required details for the participants (full name, address, valid phone number, email address, passport details: number, citizenship and date of birth). All personal details are protected and used solely for conducting the tour.

The Traveller should inform Apolotours of any fact which can affect his/her presence at the tour / excursion (e.g. allergies, illness, physical disability, special diet conditions and similar).

6. CHANGES AND CANCELLATIONS BY THE TRAVELLER

Traveller is entitled to change the booking only if the change is accepted by the service provider. The Traveller may transfer the booked tour to some other person and inform the Agency in written form on email apolotours.bdv@gmail.com. at least 10 days prior to the beginning of the tour.

The Traveller can cancel the booked service:

  • free of charge – until 15 days prior to the beginning of the tour/excursion.
  • with deposit non refunded – 14 days and less prior to the beginning of the tour/ excursion.

7. TRAVEL INSURANCE

The cost of the tour does not include the travel insurance against accidents and illnesses that may occur during the trip, or luggage loss. When the Traveller confirms a tour/excursion and complete the payment, he/she has accepted these General Terms and Conditions. Any additional insurance can be arranged directly with the Insurance Company in Montenegro, in which case Apolotours acts only as an intermediary.

8. RESOLVING COMPLAINTS

The Traveller is entitled to complain if the tour or excursion is not preformed as offered and confirmed. The Traveller has no right to complain if the about any other grounds, including bad weather conditions, traffic jams, any other similar situation or event that may cause the client’s dissatisfaction, and is not related to the quality of the reserved service.

In the case of bad weather or road conditions, or other similar events which are out of the Agency’s control and make impossible to perform the offered service in some part, it may be necessary to alter the confirmed itinerary at short notice in order to enable its conduction. The itinerary will though stay the same in terms of the offered content.

Any justified complaint about non provision of the itinerary that leads to guest dissatisfaction may be the subject of a complaint. All issues and deficiencies will be resolved on spot. If the service provider is not able to resolve the reported deficiencies on spot, and it is not related to the grounds given above, the Traveller shall get a refund in proportion to the service provided.

The complaint will be accepted only if the Traveller expresses his dissatisfaction on the spot during the program, followed by a written complaint within 7 working days, after which the service provider confirms the described situation.

9. ARBITRATION

If the guest is not satisfied with the solution that had made the Agency he/she has a right to take the issue to court jurisdiction in Podgorica.

10. NOTICE

By paying the advanced payment for reservation the arrangement accepts these General Terms and Conditions.
